These Terms of Service ("Terms") govern your access to and use of the ManageWithEXL website located at managewithexl.com (the "Site") and any property management services provided by EXL Capital Group LLC dba EXL Realty Group ("we," "us," or "our"). By accessing the Site or engaging our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use this Site or engage our services.

1. Acceptance of Terms

By accessing this Site, submitting an inquiry form, or entering into a property management agreement with us, you confirm that you are at least 18 years of age, have the legal authority to enter into binding agreements, and accept these Terms in full. Use of this Site on behalf of a legal entity constitutes that entity's acceptance of these Terms.

2. Description of Services

ManageWithEXL offers residential property management services in the Dallas–Fort Worth (DFW) metroplex, including but not limited to: tenant placement and screening, rent collection, maintenance coordination, lease administration, owner reporting, and lease renewal management. Specific services vary by plan tier. Full service descriptions are available at managewithexl.com/services.

This Site is informational in nature. Information provided — including pricing, market data, and property management guidance — is subject to change without notice and does not constitute a binding offer or guarantee of specific results.

3. No Brokerage Relationship Created by Site Use

Submitting a contact form, requesting a rental analysis, or browsing this Site does not create an agency, fiduciary, brokerage, or property management relationship. A formal relationship is established only upon execution of a written Property Management Agreement signed by both parties.

EXL Capital Group LLC dba EXL Realty Group is a licensed Texas real estate broker. All brokerage activities are conducted in accordance with applicable Texas law and TREC regulations.

4. Website Use

You agree to use this Site only for lawful purposes. You may not:

  • Use the Site in any way that violates applicable federal, state, or local laws or regulations
  • Transmit any unsolicited or unauthorized advertising or promotional material
  • Attempt to gain unauthorized access to any part of the Site or its related systems
  • Use automated tools to scrape, crawl, or extract data from the Site without written permission
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

We reserve the right to suspend or terminate access to the Site for violations of these Terms at our sole discretion.

5. Property Management Services

Property management services are governed by a separate written Property Management Agreement ("PMA") between EXL Capital Group LLC dba EXL Realty Group and the property owner. In the event of any conflict between these Terms and the PMA, the PMA controls.

Term and Cancellation. Management agreements are month-to-month after an initial 90-day onboarding period. Either party may cancel with 30 days written notice, with no early-termination penalty. If a tenant placement is in progress at the time of cancellation, no leasing fee will be charged for that placement. All owner funds, security deposits, and records are transferred within 10 business days of the effective cancellation date.

Tenant Placement. We conduct tenant screening in accordance with our documented criteria applied consistently to all applicants, in compliance with the Fair Housing Act and Texas fair housing laws. Approval or denial decisions are based on objective, non-discriminatory criteria only.

Maintenance. We coordinate routine and emergency maintenance through licensed, insured vendors. Owner approval is required for non-emergency repairs above the threshold specified in the PMA. We do not mark up vendor invoices.

Funds Handling. All owner funds are held in a designated Broker Account separate from operating funds, as required by TREC regulations and Texas law. Funds are not commingled.

6. Fees and Payment

Management fees, leasing fees, and any applicable ancillary fees are detailed in your executed Property Management Agreement and on our Pricing page. Fees are subject to change upon 30 days written notice. Continued use of our services after the effective date of a fee change constitutes acceptance of the new fees.

Management fees are deducted from collected rent before owner disbursement each month. If rent is not collected in a given month, no management fee is charged for that month on the affected unit.

7. Owner Responsibilities

As a property owner engaging our services, you agree to:

  • Provide accurate and complete information about your property, including any known defects, liens, or encumbrances
  • Maintain adequate landlord property insurance and general liability coverage throughout the management relationship
  • Respond to requests requiring owner decision within the timeframes specified in the PMA
  • Comply with all applicable federal, state, and local landlord-tenant laws and building codes
  • Notify us promptly of any changes in ownership, financing, or legal status of the property

We are not responsible for losses arising from your failure to maintain adequate insurance or to comply with applicable laws.

8. Disclaimer of Warranties

THIS SITE AND ALL INFORMATION PROVIDED ON IT ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that: (a) the Site will be uninterrupted or error-free; (b) any specific rental income, occupancy rate, or investment return will be achieved; or (c) any information on this Site is complete, accurate, or current. Rental estimates and market analyses are opinions based on available data and are not guarantees of actual rents achieved.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EXL CAPITAL GROUP LLC DBA EXL REALTY GROUP, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE OR OUR SERVICES.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total management fees paid by you to us in the three (3) months immediately preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless EXL Capital Group LLC dba EXL Realty Group and its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site or our services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party right; or (d) any inaccurate information you provide to us.

11. Intellectual Property

All content on this Site — including text, graphics, logos, photographs, and software — is the property of EXL Capital Group LLC dba EXL Realty Group or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.

12. Third-Party Links

This Site may contain links to third-party websites, including Zoho, Google, Innago, and other service providers. These links are provided for convenience only. We have no control over the content or practices of third-party sites and accept no responsibility for them. Accessing a third-party site is at your own risk and subject to that site's own terms and privacy policy.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas. You consent to personal jurisdiction in those courts.

Before initiating any legal proceeding, the parties agree to attempt resolution through good-faith negotiation for a period of at least 30 days following written notice of the dispute.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Effective Date" at the top of this page and, where appropriate, by direct notice to active clients. Your continued use of the Site or our services after the effective date of any change constitutes your acceptance of the revised Terms.
